General terms and conditions of photography services for private clients:

The general terms and conditions below apply to all shooting services, unless otherwise agreed in writing with the customer.

 

Description price and service content:

​

The price and content of the photograph will be determined in accordance with the contract drawn up on the assignment. Prices include VAT 24%.

 

Booking fees:

​

Child and family photography, pet photography, portrait photography:

​

Booking fee  will be charged when the description is booked. The booking fee is 50e, which will be refunded from the total amount of the description. In case of cancellation, the booking fee will be refunded if the cancellation is made no later than one (1) month before the event. After that, the booking fee remains with the photographer.

Wedding description:

​

A booking fee will be charged when the description is booked. The booking fee is € 150, which will be refunded from the total amount of the description. If the customer cancels the description, the fee will not be refunded. The remainder of the shooting price is due one week after the shooting date and must be paid before the photos are submitted. If the bill is not paid, the photographer has no obligation to provide photos or refund the booking fee.

Copyrights and licenses

​

The customer may copy and commission images from the submitted, processed images for unlimited personal use. Commercial use without a separate agreement is prohibited. Commercial use includes all marketing of companies, brands, services or products in both print and digital media, including newspaper use.

 

All copyrights remain with the photographer and he or she may use the images in his or her portfolio, blog, photo contests, and other photography-related marketing worldwide without specific permission, unless otherwise agreed in writing. The photographer undertakes to respect the privacy of the client and to use discretion in the public use of the images.

 

When publishing images on social media or other sources, the customer must mention the name of the photographer. The customer must not make any edits to the images, eg add filters, convert the image to black and white, etc. Image cropping required by the publishing channel is allowed. If the customer wants a different version of the pictures, they should ask the photographer.

The style, coverage, and possible destruction of the photographs

​

The client has seen the Photographer’s previous work, but accepts that the shooting style may change over time or due to circumstances. The photographer does not guarantee that the images will be similar in style to the previous images. The photographer decides the artistic style of the images according to the prevailing circumstances at his own discretion.

The photographer is obliged to take careful care of backing up the images. The backup obligation ends 6 months after the shooting .

Photo delivery

​

The customer will receive the finished photos within a week of the description for upload to the online gallery. The invoice for the shooting services must be paid in full before the images are submitted. The images remain in the gallery for 6 months after the images are uploaded, after which the images are deleted and the photographer is no longer obliged to keep the images.  The photos are available in two different sizes, full size and the recommended size for social media (2048 px long).

Customer responsibility

​

It is the customer's responsibility to guarantee the photographer peace of mind and to co-operate with the Photographer in a manner agreed in advance so that the conditions for successful photography are met. Otherwise, the photographer is not responsible for the quality of the submitted images.

The customer is responsible for the permits by obtaining the necessary permits for all locations where the photographer is performing the filming. The customer is also obliged to inform any third parties that a photographer is present and that they are likely to appear in the images. If any of the guests do not want to appear in the pictures, their photographer must be notified.

Applicable law and settlement of disputes

​

Finnish law applies to this agreement. Disputes arising from the agreement will be resolved through mediation. If the dispute concerning the sales agreement cannot be resolved through negotiations between the parties, the customer may refer the matter to the Consumer Disputes Board (www.kuluttajariita.fi). Before taking the matter to the Consumer Disputes Board, the customer must contact the Consumer Advice Center (www.kuluttajaneuvonta.fi).

5. Sources of information in the register

Personal information is obtained after the customer has been in contact with the photographer. If the customer subscribes to the Services, the information will be retained to maintain the customer relationship. The information is collected in a description agreement, from which these are recorded in the customer register.
Subscribers to the newsletter will be added to the customer register with their email address and name.
Google Analytics collects anonymous data about website usage to improve the user experience.

 

6. Purpose of the register

The personal information collected is used to maintain and manage customer relationships, as well as to enable the contacts required by the service.
If there is a billing relationship between the customer and the Photographer, the customer information may also be used for this purpose.
Recipients of the newsletter will receive up-to-date information about the campaigns and other current topics.

7. Disclosure and protection of personal data

​

The information collected in the registers will not be disclosed to third parties, with the exception of the accounting firm that handles the billing information. Data will not be transferred outside the EU.  The register is stored in the information system and is protected and located in such a way that unauthorized parties do not have access to the register data. Access to the registry requires a username and password and the servers are protected by firewalls,
Physical filming agreements are kept in a locked cabinet that is not accessible to outsiders. Electronic description agreements are protected by usernames and passwords.

8. Data Retention

​

Your information will be retained for 6 years from the end of the financial year in which the order is issued, based on the Accounting Act.

9. Your rights

 

• Right to inspect: You can inspect the personal information we store about you.

 

• Right to correct: If you find inaccuracies or omissions in your information, you have the right to ask us to correct or complete the information.

 

• Right to object: You have the right to object to the processing of your personal data at any time if you feel that we have processed your personal data unlawfully or that we do not have the right to process some of your personal data.

 

• Prohibition of Direct Marketing: You may prohibit the use of your information for direct marketing purposes at any time. We will not disclose your personal information to anyone without your consent so that they may target direct marketing to you.

 

• Right to delete: If you consider that the processing of certain information about you is not necessary for the performance of our tasks, you have the right to ask us to delete such information. We will process your request, after which we will either delete your information or provide you with a valid reason why we are unable to delete your information. If you disagree with our solution, you have the right to complain to the Data Protection Officer.

 

• Right of Restriction: You also have the right to request that we restrict the processing of disputed information until such time as the matter is resolved.

 

• Right of Complaint: You have the right to file a complaint with the Data Protection Officer if you believe that we are in violation of our privacy laws when processing your personal information.

 

• The right to transfer data from one system to another. You have the right to receive your personal data stored in the membership register in a commonly used electronic file format.
